Dear Employer,
On February 20, 2026, a new provision—Section 402.7—was added to the Pennsylvania Unemployment Compensation Law. This section specifically provides that individuals that have been separated from employment due to domestic violence shall be eligible for benefits.
Employers will still receive fact-finding forms through their usual contact method and must respond within the standard deadlines. However, to protect claimant confidentiality and comply with the law, employers will not receive non-monetary determinations or specific details about claims related to domestic violence. Employers will automatically receive relief from charges for these separations. These determinations are always considered eligible and cannot be appealed. If the department later receives information indicating this was not the correct reason for separation, a determination will be issued under a more appropriate section of law.
